1. Acceptance of Terms
By accessing or using FairVisitHealth.com, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.
2. Service Description
FairVisitHealth is a healthcare price transparency platform that helps users:
- Compare self-pay healthcare prices
- Find affordable healthcare providers nationwide
- Access AI-powered cost estimation and navigation
- View medication pricing through Cost Plus Drugs integration
3. Important Disclaimers
3.1 Not Medical Advice
FairVisitHealth provides pricing information only. We do NOT provide medical advice, diagnosis, or treatment recommendations. Always consult qualified healthcare professionals for medical decisions.
3.2 Price Accuracy & Provider Verification
ALL PRICES ARE ESTIMATES ONLY. Prices displayed on FairVisitHealth are sourced from public databases, provider websites, government price-transparency disclosures, and third-party data providers (including Google Places API). Prices may be outdated, incomplete, or inaccurate. FairPass membership provides access to comprehensive pricing information to help you find the lowest self-pay rates.
YOU MUST VERIFY PRICING DIRECTLY WITH PROVIDERS before booking or receiving any healthcare services. Confirm the full cost, what is included, payment requirements, cancellation policies, and any additional fees. FairVisitHealth is NOT responsible for price discrepancies, billing disputes, or unexpected charges.
3.3 Emergency Situations
CALL 911 IMMEDIATELY for medical emergencies. Do not use FairVisitHealth for emergency medical situations.
4. User Accounts & Device Limits
2-DEVICE LIMIT PER ACCOUNT
FairPass memberships are limited to 2 simultaneous devices per account. This limit is strictly enforced and will appear on your invoice/billing statement. Exceeding this limit will result in automatic logout from excess devices and may trigger account review.
You are responsible for:
- Maintaining account security and password confidentiality
- All activities under your account across all devices
- Staying within the 2-device limit
- Providing accurate registration information
- Notifying us of unauthorized account access
Account Sharing Prohibited
Sharing your FairPass credentials with others is strictly prohibited and constitutes theft of services. We monitor for suspicious activity including:
- Logins from more than 2 devices simultaneously
- Rapid geographic changes in login locations
- Unusual usage patterns indicating multiple users
- IP address anomalies exceeding 5 unique IPs per day
Violation consequences: Warning → 7-day suspension → Permanent termination without refund
5. Acceptable Use
You agree NOT to:
- Use the service for illegal purposes
- Submit false or misleading information
- Scrape, copy, or misuse our data
- Attempt to hack, disrupt, or overload our systems
- Share your account credentials with others
- Use more than 2 devices simultaneously
- Harass other users or post inappropriate content
- Impersonate healthcare providers or organizations
6. Subscription, Payments & Refund Policy
6.0 Which rules apply to your purchase
How you paid decides which terms govern refunds and cancellation.
- Bought on our website: we are the seller, and section 6.1 below applies.
- Bought inside our iPhone or Android app: Apple or Google is the seller and merchant of record. Their refund and cancellation policies apply, not section 6.1. Request refunds and cancel through your Apple or Google account. Nothing in these Terms limits any right you have under those policies or under consumer protection law.
6.1 ALL SALES ARE FINAL, NO REFUNDS (website purchases only)
FairPass is a digital subscription service that provides immediate access upon payment, similar to other digital content and streaming services (e.g., Netflix, Spotify, Hulu, digital movie rentals). Like renting a movie online or subscribing to a streaming service, once your subscription is activated and you have access to the service, the transaction is complete and cannot be reversed.
BY COMPLETING YOUR PURCHASE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- Immediate access is provided. Your FairPass membership activates instantly upon successful payment. You receive full, unrestricted access to all premium features, data, and tools the moment payment is confirmed.
- No refunds, credits, or exchanges. Because FairPass grants immediate access to premium healthcare pricing data, AI tools, and negotiation resources, no refunds, partial refunds, credits, or prorated amounts will be issued for any reason — including but not limited to dissatisfaction, non-use, change of mind, technical issues on your end, or duplicate purchases.
- Waiver of cooling-off period. You expressly consent to the immediate delivery of digital content and acknowledge that you waive any right to a cooling-off period or withdrawal right that may otherwise be available under applicable consumer protection laws.
- Service consumed upon access. Similar to digital movie rentals, pay-per-view events, or digital magazine subscriptions, the value of FairPass is delivered upon access. Each search query, price comparison, AI analysis, and negotiation tool accessed represents consumed digital services that cannot be "returned."
- Pre-purchase review available. Before subscribing, you have the opportunity to review our platform features, pricing tiers, sample data, and this refund policy. We encourage all users to review these materials before purchasing.
6.2 Chargebacks & Unauthorized Disputes
Filing a chargeback or payment dispute with your bank or credit card company after receiving access to FairPass constitutes a breach of this agreement and may constitute fraud. By subscribing, you agree to the following:
- Contact us first. If you have any billing concern, contact support@fairvisithealth.com before initiating a dispute with your financial institution. We are committed to resolving legitimate billing errors promptly.
- Immediate account suspension. Any chargeback or payment dispute will result in immediate suspension of your account and permanent loss of access to all FairPass features, data, and tools.
- Recovery of costs. You agree to reimburse FairVisitHealth for all costs incurred from chargebacks, including but not limited to the disputed amount, chargeback processing fees, administrative costs, and any collection fees.
- Permanent ban. Users with 2 or more chargebacks are permanently banned from the platform with no possibility of reinstatement. This ban extends to all associated email addresses, payment methods, and devices.
- Evidence submission. FairVisitHealth maintains comprehensive transaction records including your acceptance of these terms (with timestamp), IP address, usage logs, and payment confirmation. This evidence will be submitted to your financial institution in response to any dispute.
6.3 Subscription Plans & Pricing
FairPass is available in three tiers. All plans provide full access to all features:
- Monthly: $29/month — billed monthly, cancel anytime
- 3-Month: $69 every 3 months — save $18 vs. monthly
- Annual: $199/year — save $149 vs. monthly
All prices are in USD. Applicable taxes may apply based on your location.
6.4 Automatic Renewal
All FairPass subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You authorize FairVisitHealth to charge your payment method on file for each renewal period. It is your responsibility to cancel before the renewal date if you do not wish to continue.
6.5 Cancellation
You may cancel your subscription at any time through your account settings or by contacting support@fairvisithealth.com. Upon cancellation:
- Your access continues until the end of your current billing period
- No refunds or credits are issued for the remaining time in your current period
- No refunds are issued for any prior billing periods
- You will not be charged for subsequent periods after cancellation takes effect
- If you cancel and later wish to rejoin, you will need to purchase a new subscription at the then-current rate
6.6 Failed Payments
If your payment method fails, we will attempt to charge it again over a 7-day grace period. During this time, your access will continue. If payment cannot be collected after the grace period, your subscription will be suspended and premium access revoked. No refunds are provided for partial billing periods.
6.7 Device Limit
FairPass memberships are limited to 2 simultaneous devices per account. Exceeding this limit may result in automatic logout from excess devices and potential account review.
6.8 Billing Statement
For purchases made on our website, your statement shows charges from FairVisitHealth or FAIRVISITHEALTH.COM, and each invoice includes your subscription tier, amount, billing date, device limit notice, and non-refundable membership acknowledgment.
For purchases made inside our iPhone or Android app, the charge appears under Apple or Google, not under our name, because they are the merchant of record. Your receipt comes from them and is visible in your Apple or Google account rather than in your FairVisitHealth invoices.
7. Privacy & Data Compliance
FairVisitHealth Does NOT Store Health Records
We are a price comparison tool, not a medical records system. We do not collect, store, or transmit your medical records, diagnoses, or insurance information.
Security Standards: We maintain enterprise-grade security practices including 256-bit encryption, row-level security, data minimization, and regular security audits.

8. Provider Information
Provider listings are sourced from public databases. We do NOT:
- Verify provider credentials or licenses
- Endorse specific providers or facilities
- Guarantee provider availability or quality
- Control provider pricing or billing practices
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRVISITHEALTH IS PROVIDED "AS IS"WITHOUT WARRANTIES. WE ARE NOT LIABLE FOR:
- Price inaccuracies or changes
- Provider actions or quality of care
- Medical outcomes or decisions
- Service interruptions or data loss
- Third-party services or links
10. Indemnification
You agree to indemnify and hold FairVisitHealth harmless from claims arising from your use of the service, violation of these terms, or infringement of third-party rights.
11. Termination
We may suspend or terminate your account for violations of these terms (including exceeding device limits or account sharing), illegal activity, or at our discretion. Upon termination, your right to use the service ceases immediately.
12. Dispute Resolution & Arbitration
12.1 Mandatory Binding Arbitration
PLEASE READ CAREFULLY: Any dispute, claim, or controversy arising from or relating to your use of FairVisitHealth, these Terms, or the breach thereof, shall be resolved exclusively through binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, except for claims that may be brought in small claims court. The filing party pays the JAMS filing fee. Remaining costs shall be split equally between the parties unless the arbitrator determines otherwise. The seat of arbitration shall be Wilmington, Delaware.
12.2 Class Action Waiver
YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.All disputes must be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding.
12.3 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to legal@fairvisithealth.com within 30 days of first accepting these Terms. Your notice must include your name, email, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in state or federal courts in Delaware.
12.4 Governing Law
These terms are governed by the laws of the United States of America and the State of Delaware, without regard to conflict of law principles. If arbitration is inapplicable, disputes will be resolved in the state or federal courts located in Delaware.
13. Intellectual Property Rights
13.1 Copyright

13.2 Patent Pending
FairVisitHealth's proprietary healthcare price transparency technology, AI-powered cost estimation algorithms, and user interface innovations are Patent Pending. Unauthorized use, reproduction, or implementation of these technologies may result in legal action.
13.3 Trademarks
FairVisitHealth™, FairPass™, and associated logos are trademarks of FairVisitHealth, Inc. Use of these marks without express written permission is prohibited.
13.4 Prohibited Uses
- Copying, reproducing, or distributing our content without permission
- Reverse engineering, decompiling, or disassembling our software
- Scraping, data mining, or automated extraction of our data
- Creating derivative works based on our platform
- Using our trademarks without authorization
13.5 Anti-Scraping & Automated Access Policy
Unauthorized automated access to FairVisitHealth is strictly prohibited. This includes, but is not limited to:
- Using bots, spiders, crawlers, or scrapers to extract data
- Automated price monitoring or comparison tools
- Headless browsers (Puppeteer, Playwright, Selenium, PhantomJS)
- API abuse or circumventing rate limits
- Accessing data beyond normal user browsing patterns
- Bulk downloading or systematic collection of provider information
- Using VPNs or proxies to evade access controls
Enforcement: We actively monitor for scraping activity using honeypot data, behavioral analysis, and third-party bot detection. Violations may result in:
- Immediate account termination without refund
- Permanent IP and fingerprint blocking
- Legal action under the Computer Fraud and Abuse Act (18 U.S.C. § 1030)
- Civil damages for breach of contract and tortious interference
- DMCA takedown notices for scraped content

14. Public Data & Anti-SLAPP Notice
Healthcare pricing data published on FairVisitHealth is sourced from publicly available CMS databases, hospital machine-readable files, and other government-mandated transparency disclosures. This information constitutes protected speech under applicable federal and state anti-SLAPP (Strategic Lawsuits Against Public Participation) statutes. Any legal action intended to suppress, censor, or penalize FairVisitHealth for publishing public pricing data may be subject to dismissal and fee-shifting under anti-SLAPP laws.
15. Mobile App Store Terms
15.1 Scope
This section applies to your use of FairVisitHealth through our mobile applications, whether downloaded from the Apple App Store or from Google Play. Section 15.4 applies only to the iOS app.
15.2 License Grant
The FairVisitHealth mobile apps are licensed, not sold, to you for use only under these Terms. FairVisitHealth reserves all rights not expressly granted to you.
15.3 Subscription Management
If you subscribe inside the app, your subscription is billed by Apple or Google and can only be changed or cancelled in your store account: Settings > Apple Account > Subscriptions on iPhone, or Google Play > Menu > Payments & subscriptions on Android. We cannot cancel a store-billed subscription for you, and cancelling on our website will not stop that billing.
If you subscribed on our website, manage or cancel it at fairvisithealth.com/member.
Cancelling stops the next renewal. Access continues through the end of the period you already paid for.
15.4 Apple Acknowledgments
You acknowledge that: (a) these Terms are concluded between you and FairVisitHealth only, not Apple; (b) Apple has no obligation to furnish any maintenance or support services with respect to the app; (c) in the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any); (d) Apple has no obligation to address any claims you or any third party have relating to the app; (e) in the event of any third party claim that the app infringes that third party's intellectual property rights, FairVisitHealth, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim; and (f) Apple and Apple's subsidiaries are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
15.5 Google Play
For the Android app, these Terms are between you and FairVisitHealth only, not Google. Google is not a party to them and has no responsibility for the app or its content. Purchases made in the Android app are processed by Google Play as merchant of record and are subject to the Google Play Terms of Service and Google’s refund policy. Google provides no maintenance or support for the app.
15.6 Usage Rules
You must comply with the Apple App Store Terms of Service when using the iOS app, and with the Google Play Terms of Service when using the Android app.
16. Changes to Terms
We may update these terms periodically. Continued use after changes constitutes acceptance. Material changes will be notified via email or prominent notice.
